These Terms of Service and End User License Agreement ("Terms" or "EULA") constitute a legally binding agreement between you (the "User", "you", or "your") and Hightexperts LLC ("we", "us", or "our") regarding the use of our software, services, and related tools (collectively, the "Software" or "Service"). The Software is a desktop application and associated cloud services for managing and deploying game servers on your own hardware or infrastructure.
By downloading, installing, accessing, or using the Software, you agree to be bound by these Terms. If you do not agree, do not install or use the Software.
By clicking "I Accept", installing, or using the Software, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Software.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Software in accordance with these Terms and any applicable subscription terms. You may use the Software to manage and deploy game servers for your own use or for communities you participate in, including servers funded by donations or community contributions.
You may not resell, sublicense, redistribute, or offer the Software itself as a hosted service or product without express written permission from Hightexperts LLC. "Unauthorized commercial use" means, but is not limited to: selling or reselling access to the Software as a product, offering the Software as part of a paid hosting service where the Software itself is the primary value being sold, white-labeling or rebranding the Software for resale, or redistributing the Software to third parties for a fee. Using the Software to manage your own servers, including community-funded servers, does not constitute unauthorized commercial use.
DeployCat offers a fully unlocked 3-day free trial. No payment information is required to start the trial. Upon expiration of the trial, you must subscribe to a paid plan (monthly or annual) to continue using the Software. Your servers and worlds are preserved and will be available again once you subscribe.
The Software, including its code, design, assets, and all intellectual property rights therein, is and remains the exclusive property of Hightexperts LLC and its licensors. These Terms do not transfer any ownership rights to you. You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software without express written permission.
DeployCat is an independent, unofficial third-party software tool developed by Hightexperts LLC. It is not affiliated with, endorsed by, sponsored by, approved by, or associated with any game publisher or developer.
The following trademarks and game titles are the property of their respective owners. DeployCat is not an official product of any of these companies:
All other game names, trademarks, logos, and intellectual property referenced in or used with DeployCat are the property of their respective owners. Use of these names is solely for descriptive and compatibility purposes.
You are solely responsible for complying with the End User License Agreements, Terms of Service, and any other rules imposed by the publishers of the games you choose to host.
This Software includes third-party open-source components, which are licensed under their respective licenses:

These components are provided "as is" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. The above copyright notices and permission notices shall be included in all copies or substantial portions of the Software.
You agree to use the Software only for lawful purposes. You may not (and may not allow others to):
Paid subscriptions are processed securely through Stripe. By purchasing a subscription, you authorize Stripe to automatically charge your payment method on a recurring basis (monthly or annual, depending on your selected plan) until you cancel. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel your subscription at any time through the DeployCat app or by contacting billing@DeployCat.app. Cancellation takes effect at the end of your current paid billing period — you will retain access until then.
Refunds are governed by our Refund Policy. Where required by applicable law, you may be entitled to a refund as described in that policy. Any refund requests should be directed to billing@DeployCat.app.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Software will be error-free, uninterrupted, secure, or compatible with all hardware, operating systems, or game versions. We do not guarantee any specific uptime, availability, performance, or compatibility. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any downtime, service interruptions, or data loss resulting from such unavailability.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HIGHTEXPERTS LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, including but not limited to:
Our total aggregate liability under these Terms shall not exceed the amount you paid to us (if any) for the Software or Service in the twelve (12) months preceding the claim. This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
You assume all risks associated with deploying and managing servers on your hardware.
You agree to indemnify, defend, and hold harmless Hightexperts LLC and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:
Your use of the Software is also governed by our Privacy Policy. By using the Software, you consent to the data practices described therein.
We may terminate or suspend your access to the Software at any time, including for breach of these Terms. No refunds will be issued for any termination, except where required by applicable law.
Upon termination, you must cease all use and uninstall the Software. We will delete your account data from our systems within thirty (30) days of termination, except where retention is required by law or to resolve disputes. You are responsible for exporting any data you wish to retain before termination, as we are not obligated to provide data after termination.

Hightexperts LLC shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, pandemics, government actions, labor disputes, power outages, internet or telecommunications failures, or third-party service disruptions.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts located in Texas, USA.
We may update these Terms from time to time. Continued use of the Software after changes constitutes acceptance of the updated Terms.
